Florida RINOs install Democrat gun confiscation scheme
Florida has been one of the leaders in conservative policies at the state level.
But one area where the state lags behind other red states is Second Amendment freedom.
The 2018 shooting at Marjory Stoneman Douglas High School in Parkland, Florida, resulted in the RINOs in the Republican-controlled State Legislature passing a slew of gun control laws.
A red flag gun confiscation law that has become the crown jewel of gun control for Democrats at the state level was passed in response to the shooting.
The law subverts the Second Amendment and constitutionally protected due process rights.
Red flag laws allow someone to file a request with a court to seize the firearms of a gun owner because they are alleged to be a threat.
Gun owners do not have the opportunity to defend themselves against these allegations.
A bitter former spouse could file a red flag against a gun owner and have their firearms confiscated.
That leaves gun owners with a long and expensive legal battle to get their guns and Second Amendment rights restored.
Ron DeSantis calls for Florida’s red flag gun confiscation law to be overturned
Florida Governor Ron DeSantis used his State of the State address to call for the repeal of the red flag gun confiscation law.
“If you look at this red flag law that was passed, they can go in and say, ‘this person’s a danger, they should have their firearms taken away,’ which is property in addition to being something connected with a constitutional right,” DeSantis explained. “The burden shifts where you have to prove to a court that you are not a menace or a threat. That’s not the way due process works.”
More than 10,000 red flags have been filed by law enforcement in Florida from July 2022 to the end of 2024.
Guns Owners of America Florida State Director Luis Valdes called the red flag law a distraction from the real problem.
“Red flags is simply a band-aid on a true problem that there’s a mental health issue in this country,” Valdes said. “There’s no public funding for it. There’s no public resources for it and all they do is they think, oh, if someone’s crazy, we’ll just take the guns away from them.”
Florida is also the only Republican-controlled state in the country that bans open carry.
DeSantis admitted that Florida lags behind other red states in Second Amendment freedoms.
“The free state of Florida has not exactly led the way on protecting Second Amendment rights. We need to be a strong Second Amendment state,” DeSantis said.
No lawmakers have filed a bill yet to repeal Florida’s red flag law.
The support of DeSantis in repealing the red flag could build some momentum to overturn this attack on the Second Amendment and due process.
