Florida law protecting kids from transgenderism is in a legal battle
The Left is targeting kids with an extremist agenda that pushes them to life-altering changes to their bodies to change genders.
Florida Governor Ron DeSantis has been fighting to let kids be kids.
He signed a bill into law in 2023 that followed the science to outlaw harmful drugs and surgeries for minors to change genders.
Sex reassignment surgeries, puberty blockers, and cross-sex hormone treatments were prohibited for kids.
The Left sued in federal court to block the law from going into effect.
U.S. District Judge Robert Hinkle, who was appointed by former President Bill Clinton, issued an injunction against Florida enforcing the law claiming that most of it was unconstitutional in June.
He ruled that “gender identity is real” and that “cross-sex hormones” are part of proper medical treatment for minors dealing with gender identity issues.
Florida appealed Judge Hinkle’s ruling, and DeSantis predicted the state would be successful on appeal.
His prediction came true after a ruling from a federal appeals court.
Judges side with DeSantis and common sense
The 11th Circuit Court of Appeals sided with Florida and lifted the injunction placed by Judge Hinkle on the law blocking transgender treatments for kids.
A 2-to-1 decision found that the district court “likely misapplied the presumption that the legislature acted in good faith when it concluded that the prohibition and regulation provisions, and the implementing rules, were based on invidious discrimination against transgender minors and adults.”
DeSantis celebrated the appeals court ruling as a victory for common sense.
“It is the mutilation of minors that is harming people,” DeSantis explained. “It is wrong to do this. You do not take some 14-year-old and pump them with hormone blockers and try to change their sex with an operation. It’s wrong. People that have gone through that, there’s so much lasting damage that has happened. It’s not based on sound science.”
He pointed to left-wing European countries banning transgender treatments for minors based on rigorous scientific studies that found it was not safe or effective.
The United Kingdom, Sweden, and other European countries have pulled the plug on permanently altering kids with these treatments.
“What we did by doing that is to just recognize — I mean, how is it, how could we possibly say as a state that you cannot have a tattoo at age 14; you would not be able to go sit at a bar and drink beer at age 16; you wouldn’t be able to do that, but somehow, you could have these mutilation procedures where they’re trying to change your body parts and try to change your sex at age 15 or 14? How is it? And because it’s obviously inappropriate in these other situations, of course, it’s inappropriate here,” DeSantis explained.
The Florida Governor said that no judge would have found the law unconstitutional ten years ago.
