Democrat judge rules against Florida law against child sex changes

Florida Governor Ron DeSantis signed a commonsense law last year that prohibited minors from receiving transgender treatments from doctors.

Democrats immediately filed a suit against the law claiming that restricting children from taking opposite sex hormones was denying them healthcare.

A federal judge appointed by former President Bill Clinton struck down major sections of the law as unconstitutional.

U.S. District Judge Robert Hinkle said in his ruling that “gender identity is real” and that a “widely accepted standard of care” for kids includes hormones and puberty blockers.

“Florida has adopted a statute and rules that ban gender-affirming care for minors even when medically appropriate,” Hinkle wrote. “The ban is unconstitutional.”

The Left uses a false narrative to paint transgender treatments, like abortion,  as medical care. 

“The state of Florida can regulate as needed but cannot flatly deny transgender individuals safe and effective medical treatment,” Hinkle stated. “Treatment with medications routinely provided to others with the state’s full approval so long as the purpose is not to support the patient’s transgender identity.”

Florida plans to appeal the ruling.

“We disagree with the court’s erroneous rulings on the law, on the facts, and on the science,” DeSantis deputy press secretary Julia Friedland said in a statement.

Ron DeSantis responds to setback from Clinton judge

A reporter asked DeSantis at a press conference why Florida should use taxpayer money to appeal the ruling.

“Because it’s wrong to mutilate minors. It is wrong to perform a sex change on a 16-year-old,” DeSantis said. “You’re not allowed to get a tattoo, but somehow you can have your privates cut off? Give me a break. This is wrong.”

DeSantis predicted that Florida would be able to successfully appeal the ruling from the Clinton judge.

Alabama passed a similar law that was upheld by the Eleventh Circuit Court of Appeals.

“They upheld Alabama’s law which was almost identical to Florida’s law,” DeSantis said. “This will be reversed. There is no question that it will be reversed.”

He said that protecting children from harm was well within the state’s right.

“Of course, the state can protect children against this, and we had very powerful testimony how this is irreversible,” DeSantis said.

The Florida Governor dismissed the idea of not appealing because that would let Democrat judges set the state’s policy.

“If you say that we shouldn’t do that, you’re saying that any liberal judge should be able to veto the policy of the state of Florida because they go to the same judges every time, we lose almost every time, and then we win on appeal almost every time,” DeSantis said.

Democrats always turn to the legal system as their last resort to stop laws they do not like.

This time it seems that Florida will eventually come out on top in the legal battle.
